2. Personal Data, Purposes of Processing, and Legal Bases

The use of our website is generally possible without having to provide personal data. The provision of personal data is voluntary.

Personal data means any information relating to an identified or identifiable natural person (hereinafter “data subject”). A natural person is deemed identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the identity of that natural person.

The purpose of data processing is the operation of this website with information about our service offering, including contact options and online application functions.

Personal data will only be collected on our website where this is:

  1. necessary for the use of the website (legal basis: Art. 6(1)(a) and/or Art. 6(1)(b) GDPR),
  2. necessary to safeguard our legitimate interest in improving the user experience and maintaining secure use (legal basis: Art. 6(1)(f) GDPR),
  3. necessary for the use of services offered on the website and for pre-contractual measures, in particular form submissions (legal basis: Art. 6(1)(a) and/or Art. 6(1)(b) GDPR), or
  4. necessary for the conclusion and performance of a contract (legal basis: Art. 6(1)(a) and (b) GDPR).

3. Access Data / Server Logfiles

When visiting our website, the servers automatically store information transmitted by your browser in so-called server logfiles. This information includes:

  1. Name of the retrieved webpage,
  2. File,
  3. Date and time of access,
  4. Notification of successful retrieval,
  5. Browser type and version,
  6. Operating system of the user,
  7. Referrer URL,
  8. IP address (anonymised),
  9. Provider.

This data is not merged with other data sources. The information is used pursuant to Art. 6(1)(f) GDPR solely for the analysis and maintenance of the technical operation of the servers and the network.

4. Cookies

Our website uses cookies. Cookies are small files that enable device-specific information to be stored on the user’s access device (PC, smartphone, etc.). They serve, on the one hand, to improve the user-friendliness of websites and thereby benefit users (e.g. by storing login data). On the other hand, they serve to collect statistical data on website use and to analyse it in order to improve the offering. Further details are set out in the subsequent sections of this Privacy Policy.

Insofar as you provide consent for non-essential cookies, the legal basis is Section 25(1) TDDDG and Art. 6(1)(a) GDPR (consent). You can obtain further information on the cookies and services used in our Consent Management Tool and may revoke your consent at any time with effect for the future, without disadvantage.

As a user, you can influence the use of cookies. Most browsers have an option to restrict or completely prevent the storage of cookies. However, please note that use of the website, and in particular the user experience, may be restricted without cookies.

5. Contact via E-Mail

If you send us inquiries via e-mail, the details you provide, including the contact data you include, will be stored by us for the purpose of processing the inquiry and for possible follow-up questions, pursuant to Art. 6(1)(b) GDPR. We will never pass on this data without your consent.

6. Member Account

On our website you have the option to create a member account and thereby become a member of the Global Bone Management Network. Via the member account you can enter and maintain your profile data, plan, create, book, and view events and workshops, as well as take out subscriptions.

To create your account, you will first be required to register once and set a password. You will then gain access to our protected member area. Further details can be found in our Terms of Use.

We process the data you provide exclusively to provide you with access to your member area and subscription functions. Data processing is carried out solely for the purposes arising from the registration contract and for the performance of the contract, in compliance with statutory provisions under the Federal Data Protection Act (BDSG).

The legal basis is your consent pursuant to Art. 6(1)(a) GDPR, and processing also serves the necessity of contract performance pursuant to Art. 6(1)(b) GDPR.

7. Google Analytics

Our website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics enables us to analyse the behaviour of visitors on our website, for example which pages are accessed, how long a visit lasts, and from which sources users reach our site. This information helps us to improve the user-friendliness of our website and to better tailor our content to the interests of our visitors.

Cookies are used to store information about your use of our website. Data collected includes your IP address (in anonymised form), device and browser information, and usage data. The information collected may be transferred to and processed in the USA. We have configured Google Analytics to anonymise IP addresses and have entered into a data processing agreement with Google.

The legal basis for the use of Google Analytics is your consent provided via the cookie banner (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). 8. Google Search Console

We use Google Search Console on our website, a free service from Google that allows us to monitor the visibility of our website in search results and to make technical optimisations. The controller is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, if you are in the European Economic Area or Switzerland. Google Ireland Limited is affiliated with Google LLC, headquartered in the USA.

Through the Search Console we only receive statistical and aggregated information, such as how our site appears in search results and which search queries lead to visits. No personal data of website visitors is transmitted to us. There is no processing of IP addresses or individual user tracking by us.

Since the Search Console does not process your personal data, its use is unobjectionable under data protection law. Further information on Google’s data processing can be found in Google’s Privacy Policy: https://policies.google.com/privacy.

9. Facebook (Meta) Pixel

We use the so-called Facebook Pixel, also referred to as Meta Pixel, on our website. This is an analytics tool provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. The pixel enables us to measure the effectiveness of our advertisements on Facebook and Instagram and to target ads to users who have already shown interest in our website.

The pixel collects technical information such as your IP address, browser and device details, or your usage behaviour, and transmits this to Meta. This data may also be linked with your Facebook or Instagram profile if you are logged in there. Transfer of data to the USA is possible.

The use of the pixel takes place solely on the basis of your consent, which we obtain via our cookie banner (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). You may withdraw your consent at any time by adjusting the settings in the banner. Further details can be found in Meta’s Privacy Policy: https://www.facebook.com/about/privacy.

10. Google Maps

Our website uses Google Maps to display interactive maps, convert entered addresses into geo-data that can be displayed on maps, and to deliver correct time zones. The provider is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. For users residing in the European Economic Area or Switzerland, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, is the controller responsible for the Google services (“Google”). Google Ireland Limited is affiliated with Google LLC and is also required to comply with the GDPR.

Both Google LLC and Google Ireland Limited are certified under the EU-US Data Privacy Framework.

When accessing the subpages that include Google Maps, information about your use of our website (e.g. your IP address) is transmitted to and stored on Google servers in the USA. This occurs regardless of whether Google provides a user account that you are logged into or whether no user account exists. If you are logged into Google, your data will be directly linked to your account. If you do not want data to be associated with your Google profile, you must log out before activating the button. Google stores your data (even for non-logged-in users) as usage profiles and analyses them.

The legal basis for the use of Maps is Art. 6(1)(f) GDPR or, where you have provided consent via our website notice (“cookie banner”), Art. 6(1)(a) GDPR, Section 25(1) TDDDG. 11. Recipients of Personal Data

Personal data will only be disclosed by us, aside from the above, to the following categories of recipients:

  1. To our employees, and
  2. To the hosting provider of our website. The host is Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Deutschland. We have concluded a data processing agreement (DPA) with our hosting provider.

Apart from this, your personal data will not be disclosed to third parties without your express consent, unless we are legally obliged to do so pursuant to Art. 6(1)(c) GDPR or disclosure is strictly necessary for the performance of a contractual relationship pursuant to Art. 6(1)(b) GDPR.

Please note that data transmission on the Internet (e.g. when communicating by e-mail) may have security vulnerabilities. Complete protection of data against access by third parties is not possible.

12. Duration of Storage

We delete your personal data immediately once the purpose of processing has been achieved. For example, we store your data from e-mails until your inquiry has been fully processed and completed. The information is then usually deleted.

Data from your member area will be deleted upon termination of your membership.

In addition, we check on an annual basis whether stored data can be deleted.

Please note that certain data is subject to statutory commercial and tax retention obligations of at least six years (Section 257 HGB) or ten years (Section 147 AO).

13. Rights of Data Subjects

You are not legally required to provide your personal data. However, provision may be necessary for concluding a contract or for using certain website functions. If you do not provide your data, a contract or website function may not be available.

No automated decision-making takes place on the website, and no profiling is carried out.

Data subject rights arise in particular from Articles 15 to 23 and Article 77 GDPR, as well as from Sections 32 to 37 of the new Federal Data Protection Act (BDSG). In relation to your personal data, you have the right to:

  2. Rectification, Art. 16 GDPR
  3. Erasure, Art. 17 GDPR
  4. Restriction of processing, Art. 18 GDPR
  5. Data portability, Art. 20 GDPR

If you have given consent to the processing of personal data, you have the right to:

  1. Withdraw consent, Art. 7 GDPR,
  2. with effect for the future.

Furthermore, you have the right to object to the processing of personal data:

  1. Right to object, Art. 21 GDPR
  2. You have the right, on grounds relating to your particular situation, to object at any time to the processing of personal data concerning you, which is carried out on the basis of Art. 6(1)(f) GDPR (data processing on the basis of a balancing of interests). If you object, we will no longer process your personal data, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise, or defence of legal claims.
  3. In individual cases, we process personal data for direct marketing purposes. If this is the case for you, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing. If you object to processing for direct marketing purposes, we will no longer process your personal data for these purposes.

If you believe that the processing of your personal data violates data protection law, you always have the:

  1. Right to lodge a complaint

with the competent supervisory authority, cf. Art. 77 GDPR. Without prejudice to any other administrative or judicial remedy, you have this right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, your workplace, or the place of the alleged infringement, if you consider that the processing of your personal data infringes the GDPR.
